Most of our clients try first to qualify for Chapter 7, where you get a fresh start without having to repay your debts. In Chapter 7, you are usually allowed to keep your house or car if you are current on the payments, and most of our clients do not lose anything by filing except for their burdens. While most of our clients qualify for Chapter 7, some do not – either because they make too much money or because they have too many assets.
If your situation is too complicated or you don't otherwise qualify for Chapter 7, we will screen you for Chapter 13, where you go on a payment plan to pay back part of what you owe. Chapter 13 is useful for people who are behind on a house or car payment because you are allowed to catch up the missed payments in Chapter 13. In Chapter 7 if you are behind on a house or car payment you will probably lose the asset, and we cannot use bankruptcy to protect the property for you.
Chapter 11 cases are complicated, and not many attorneys accept them. Mr. Paloci, the attorney, enjoys the challenge and will accept Chapter 11 debtors in Los Angeles, Woodland Hills, Ventura County, and Santa Barbara.
